ZipAppointments® Terms of Service ("Terms")

Please read these Terms of Service ("Terms") carefully before using the ZipAppointments® booking app (the "Service") operated by ZipAppointments® ("us," "we," or "our").

Your access to and use of the Service is subject to your acceptance of and compliance with these Terms. These Terms apply to all users, including visitors and registered members. We also offer a 100% money-back guarantee on our services.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree with any part of the Terms, you may not use the Service. By using our platform, you confirm that you are at least 18 years old and have the legal capacity to enter into a contract. If you are using our services on behalf of an organization, you warrant that you have the authority to bind that organization to these Terms.

You agree not to engage in any activities that violate these Terms, applicable laws, or the rights of others. This includes, but is not limited to, unauthorized access to our systems, distribution of harmful code, and any actions that disrupt the functionality or security of the Service.

You agree to indemnify and hold ZipAppointments®, its affiliates, officers, directors, employees, and agents harmless from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

Intellectual Property Rights

Limited License. The Site, and all the materials contained on it are our property and/or the property of our affiliates or third party providers, and are protected by copyright, trademark, and other intellectual property laws. You may only use the Site and the materials on it as authorized by us. You may not use the Site or the materials on it in any manner that violates the privacy rights, publicity rights, copyrights, trademark rights, patent rights, contract rights, or any other rights belonging to us or a third party. We reserve the right, at any time and without notice, to suspend, cancel, or terminate your right to use the Site (or any portion of the Site) for violation (whether repeated or not) of copyrights or any other rights belonging to us or a third party.

You acknowledge and agree that ZipAppointments® shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by your use of or reliance on any content, goods, or services available on or through any third-party websites or services.

Intermediary Role

ZipAppointments® acts as a scheduling platform and does not directly provide the services booked through our platform. Instead, we connect users with service providers based on availability and preferences.

We do not guarantee the quality, availability, or outcome of any service provided by third-party professionals. Our role is to facilitate appointment bookings and streamline the process for both users and service providers. Any disputes or issues related to the service itself must be addressed directly with the respective provider.

Authorization

By accepting these Terms and Conditions, the Customer authorizes ZipAppointments® to act as their agent for scheduling and managing appointments with service providers.

We do not guarantee the quality, availability, or outcome of any service provided by third-party professionals. Our role is to facilitate appointment bookings and streamline the process for both users and service providers. Any disputes or issues related to the service itself must be addressed directly with the respective provider.

Limitation of Liability

The Customer acknowledges that ZipAppointments' role is limited to facilitating appointment bookings, and ZipAppointments shall not be liable for the quality, outcome, or fulfillment of services provided by third-party professionals.

Additionally, any fees paid for using the platform do not cover legal expenses related to disputes between the Customer and service providers. ZipAppointments is not responsible for initiating or funding any legal action on behalf of Customers.

Exclusions and Limitations

Services booked through ZipAppointments may have certain restrictions and limitations, including but not limited to availability, service provider policies, and the scope of services offered. We do not guarantee service outcomes, provider reliability, or the fulfillment of any specific requests.

It is the Customer’s responsibility to communicate directly with the service provider regarding any special requirements, pre-existing conditions, or service expectations. ZipAppointments and its platform are provided "as is" and "as available." We make no representations or warranties, express or implied, regarding the accuracy, reliability, suitability, or availability of the platform or the services booked through it.

Cancellation and Termination

Cancellation by the Customer:

If a customer wishes to cancel their appointment or service booking with ZipAppointments®, they must follow the designated cancellation process outlined in the platform. This may involve contacting customer support or submitting a cancellation request through the app or website. Customers may be required to provide relevant details such as their booking reference and reason for cancellation. Depending on the service provider’s policy, cancellation fees or penalties may apply.

Cancellation by ZipAppointments® :

ZipAppointments reserves the right to cancel or terminate a booking or user access under certain conditions, including but not limited to:

  • Breach of Terms: If a customer violates the platform’s terms and conditions, ZipAppointments may cancel the booking or restrict access to the service.
  • Fraudulent Activity: If there is evidence of fraudulent activity, misrepresentation, or abuse of the service, ZipAppointments may take necessary action, including account suspension.
  • Service Provider Unavailability: If a service provider is unable to fulfill a booking due to unforeseen circumstances, ZipAppointments may cancel the appointment and, where possible, assist in rescheduling.

All cancellations and terminations will be handled in accordance with the platform’s policies and applicable terms of use.

Governing Law

These Terms shall be governed and construed in accordance with the laws of Texas, United States, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have had between us regarding the Service.

Law of Agency

The law of agency governs commercial relationships by addressing a range of fiduciary duties, including contractual, quasi-contractual, and non-contractual obligations. This law permits an individual or a company to act as an agent on behalf of another person, referred to as the principal. As an agent, they can engage with third parties to complete tasks on behalf of the principal. This is legal because the principal grants the agent the authority to act or complete tasks for them. The CAN-SPAM Act is a law that sets the rules for commercial email, establishes requirements for commercial messages, gives recipients the right to have emails stopped from being sent to them, and spells out tough penalties for violations.

We collect your email address in order to:
  • Send information, respond to inquiries, and/or other requests or questions.
  • To be in accordance with CANSPAM we agree to the following:
  • NOT use false or misleading subjects or email addresses.
  • Identify the message as an advertisement in some reasonable way.

Disclaimers

We reserve the right to modify or replace these Terms at our sole discretion at any time. If a revision is considered material, we will provide at least 30 days' notice before the changes take effect. The determination of what constitutes a material change will be made solely by us.

By continuing to access or use our Service after the updated Terms become effective, you agree to be bound by them. If you do not accept the new Terms, you must discontinue use of the Service.
